Sure Swift Couriers Customer Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Sure Swift Couriers website ("Platform"), including browsing, purchasing products from vendors, ordering food from restaurants, and utilizing our delivery services across Jamaica. By accessing or using the Platform, you ("Customer" or "you") agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Sure Swift Couriers ("we," "us," or "Sure Swift") operates as a marketplace connecting customers with vendors and restaurants. We facilitate orders and deliveries but are not the seller of products or food items.
1. User Eligibility
- You must be at least 18 years old or have legal capacity to enter into contracts under Jamaican law.
- You must provide accurate information during account registration or checkout, including name, address, phone number, and payment details.
- Accounts are for individual use and may not be shared. You are responsible for maintaining the confidentiality of your account credentials.
2. Ordering and Payment
- Placing Orders: You may browse and purchase products from vendors or order food from restaurants listed on the Platform. Orders are subject to availability and confirmation by the vendor or restaurant.
- Payment: All payments are processed securely through our payment gateway. You agree to pay the total amount, including product/food prices, delivery fees, and applicable taxes (e.g., General Consumption Tax - GCT).
- Order Confirmation: Orders are binding once confirmed. Sure Swift is not responsible for errors in orders due to inaccurate information provided by you.
- Cancellations: Orders may be canceled before preparation by the vendor/restaurant. Cancellation fees may apply if the order has progressed.
3. Delivery
- Deliveries are handled by Sure Swift Couriers across Jamaica. Estimated delivery times are provided but not guaranteed, as they depend on factors like traffic, weather, or vendor preparation.
- You must provide a valid delivery address and be available to receive the order. Failed deliveries may incur additional fees.
- Sure Swift is not liable for delays or damages caused by vendor packaging, incorrect addresses, or force majeure events (e.g., natural disasters).
4. Refunds and Returns
- Refunds and returns are governed by our Refund & Returns Policy, available on the Platform. Issues with products or food (e.g., damaged, incorrect, or unsatisfactory) should be reported to the vendor/restaurant via the Platform within the specified timelines (7 days for non-food, 24 hours for food).
- Sure Swift facilitates disputes but decisions are primarily made by the vendor/restaurant, in compliance with the Consumer Protection Act (2005, amended 2012).
- Delivery fees are non-refundable unless the error is attributable to Sure Swift.
5. Privacy and Data Protection
- We collect personal information (e.g., name, address, payment details) to process orders and deliveries, in compliance with the Data Protection Act (2020).
- Your data is protected with reasonable security measures. We may share necessary information with vendors, restaurants, and payment processors for order fulfillment.
- By using the Platform, you consent to our Privacy Policy, which details data collection, use, storage, and sharing practices.
- In case of a data breach, we will notify affected users as required by law.
6. Intellectual Property
- All content on the Platform, including logos, images, and text, is owned by Sure Swift or its licensors and protected by Jamaican copyright laws.
- You are granted a limited, non-exclusive license to use the Platform for personal shopping purposes. You may not copy, modify, or distribute content without permission.
7. User Conduct
- You must not use the Platform for illegal activities, including fraud, harassment, or uploading harmful content.
- Prohibited actions include attempting to bypass security, reverse-engineer the Platform, or direct traffic away from Sure Swift.
- Reviews and feedback must be honest and not violate laws (e.g., no defamatory statements).
8. Liability and Disclaimers
- The Platform is provided "as is" without warranties. Sure Swift disclaims liability for product quality, accuracy of listings, or vendor/restaurant performance, as per the Sale of Goods Act.
- We are not liable for indirect, consequential, or punitive damages arising from Platform use, orders, or deliveries.
- You agree to indemnify Sure Swift against claims resulting from your misuse of the Platform or breach of these Terms.
- Maximum liability is limited to the order value.
9. Termination
- Sure Swift may suspend or terminate your account for violations of these Terms, fraudulent activity, or at our discretion.
- Upon termination, you must cease using the Platform, but outstanding orders will be fulfilled where possible.
10. Governing Law and Dispute Resolution
- These Terms are governed by Jamaican laws, including the Consumer Protection Act and Electronic Transactions Act (2006).
- Disputes will be resolved through negotiation or mediation. Unresolved disputes shall be submitted to Jamaican courts.
11. Amendments
- Sure Swift may update these Terms with notice via email or the Platform. Continued use constitutes acceptance of changes.
